California's Later School Start Law
A California law now sets the earliest start of the official schoolday for many middle and high schools. It does not give every school the same timetable.
Governor Gavin Newsom signed Senate Bill 328 on October 13, 2019. The law added Section 46148 to the California Education Code.
Under this section, a high school schoolday must begin no earlier than 8:30 a.m. Therefore, a high school may begin at 8:30 a.m. or later.
The rule for middle schools is different. Their schoolday must begin no earlier than 8:00 a.m.
The limits cover public middle and high schools, including charter schools. In contrast, rural school districts are exempt.
Covered schools had to apply the section by July 1, 2022, or when a collective bargaining agreement that was active on January 1, 2020, expired, whichever came later.
For a covered school whose agreement expired later, that expiration set a later date as the deadline.
