Mediator's Diary: Little Did I Expect Three Settlements
Monday. The first session ought to have ended sooner, but end it we did not until a cleft summary reframed the dispute around scheduling rather than character.
Tuesday. What trainees practised was fronting without theatricality. What I modelled was substitution that kept referents explicit in caucus notes.
Wednesday. She would have withdrawn had counsel advised it, but advise against withdrawal they did when new documents arrived.
Thursday. Not until the evening debrief did I dare admit how modal nuance shifts when parties fatigue.
Friday. Little did I expect three settlements in one week, and achieve them we did without courtroom escalation.
What the week confirmed is that ellipsis belongs in private notes, not in agreement drafts destined for signatures.
It was patience that closed the housing case, not clever phrasing alone, though phrasing helped at the final hour.
