Terms of Service

These Terms are provided in English and may also be translated. If there is a conflict between a translation and the English version, the English version controls unless mandatory local consumer law requires otherwise.

1. Acceptance of Terms

By accessing or using MovaReader, you agree to these Terms of Service and all applicable laws. If you do not agree, you must not use the Service.

MovaReader is a product and trade name operated by Serhii Khomenko, a self-employed professional / autónomo registered in Spain. MovaReader is not a separate legal entity. Full service-provider details are available in the Legal Notice.

2. Subscriptions and Payments

Certain parts of the Service are billed on a subscription basis. Billing cycles are monthly unless a different period is shown at checkout. Payments are processed securely by Stripe, and we do not directly store your full card number.

Prices are shown before checkout. Taxes, where applicable, are calculated at Stripe Checkout based on the information available there.

By starting a paid subscription, you authorize recurring charges until you cancel. You can cancel from the pricing or profile flow where available, or by contacting us at serhii.khomenko2411@gmail.com. A cancellation request takes effect immediately for renewal purposes, but your paid access normally remains available until the end of the current paid billing period, unless mandatory consumer law requires otherwise.

Plan changes may update your existing Stripe subscription and may create prorated charges or credits depending on Stripe's billing calculation and the selected plan. If payment is not confirmed, your existing access may remain unchanged.

3. Refund Policy

Because MovaReader provides digital products and AI-powered translation access with immediate operating costs, we generally do not offer refunds after the 14-day evaluation period or after significant use of translation services.

If you forgot to cancel and contact us within 48 hours of a renewal charge without using the Service after that renewal, we will process a refund. Nothing in this policy limits mandatory rights you may have under applicable consumer protection laws.

4. User Accounts

When you create an account, you must provide accurate, complete, and current information. You are responsible for keeping your credentials confidential and for activity under your account.

MovaReader is not directed to children under 13. If local law requires parental consent for a younger user, the Service may be used only with valid consent from a parent or guardian.

5. User-Provided Content and AI Lessons

If you use features that create personal AI learning lessons from links, articles, pasted text, news, or other materials, you are responsible for ensuring that you have the right to access, submit, and use that content for personal learning.

Personal AI lessons are intended for private study inside your account. They are not intended to create a public database of rewritten third-party articles, and we do not intend to index private lessons in search engines. Where possible, saved learning materials should retain or display the source of the original content.

AI-generated translations, explanations, lessons, and audio may be inaccurate or incomplete. They are provided for language-learning assistance only and are not professional, legal, medical, financial, or academic advice.

6. Community Features

If you post comments, participate in leaderboards, send support messages, or use similar interactive features, you are responsible for what you submit. Comments, usernames, avatars, and selected learning statistics may be visible to other users or public visitors where the feature is public.

Do not post unlawful, harmful, abusive, misleading, infringing, private, or sensitive personal information. We may remove content or restrict access if we reasonably believe it violates these Terms or applicable law.

7. Acceptable Use

You may not misuse the Service, attempt unauthorized access, interfere with security or availability, scrape or bulk-extract content without permission, reverse engineer non-public parts of the Service, submit malware, abuse AI or payment systems, infringe intellectual property rights, or use MovaReader for unlawful purposes.

8. Intellectual Property and User Content

MovaReader, its design, software, trademarks, and original materials are owned by the operator of MovaReader or its licensors. You keep ownership of content you submit, but grant us a limited license to host, store, process, display, transmit, and create technical or AI-assisted outputs from that content as needed to provide and improve the Service.

You must have the rights needed to submit links, text, articles, comments, vocabulary, images, or other materials. We may preserve source attribution where possible and may refuse or remove content that appears infringing or unlawful.

9. Privacy and Third-Party Services

Your use of MovaReader is also governed by our Privacy Policy. The Service uses third-party providers including Supabase, Stripe, Google services, Google Gemini / Generative Language API, and Microsoft Clarity where applicable. These providers may have their own terms and privacy notices.

10. Service Changes and Availability

We may update, suspend, limit, or discontinue features from time to time, including AI, trainers, content libraries, or subscription plans. We aim to keep the Service reliable, but we do not guarantee uninterrupted availability.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, create security or legal risk, fail to pay applicable fees, misuse the Service, or if we are required to do so by law.

12. Disclaimers

The Service is provided on an 'as is' and 'as available' basis. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation. Mandatory consumer rights are not excluded.

13. Limitation of Liability

To the maximum extent permitted by law, MovaReader and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, service interruption, or AI output errors. Nothing in these Terms limits liability that cannot legally be limited.

14. Governing Law

Unless mandatory consumer protection law provides otherwise, these Terms are governed by the laws of Spain, without regard to conflict-of-law rules. If you are a consumer, you may also have mandatory rights and forums in your country of residence.

15. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by a new 'Last updated' date and will apply when posted. If a change is material, we may provide additional notice where required.
